You agree that any Content you submit is not being provided in confidence or trust, and that no confidential or fiduciary relationship is intended or created between you and Bionews, Inc. in any way, with respect to the Content or otherwise.
Any and all Content submitted by you must be original, truthful, and created solely by you. You shall not submit any Content that: (1) contains any obscene, offensive, libelous, defamatory, tortuous, derogatory, unlawful, abusive, threatening, harassing, discriminatory, false, pornographic, or otherwise inappropriate material; (2) contains any confidential information or information that could identify any third party; (3) infringes, dilutes, misappropriates, or otherwise violates any rights of any third party, including, but not limited to, copyright, patent, trademark, trade secret, privacy, publicity, or other rights under any contract or applicable law; (4) contains information to which a third party has rights; (5) contains any medical advice or offers a diagnosis; or (6) violates any law or regulation.
You are liable for any injury or damages caused or claimed to be caused by any and all Content you submit, and you agree to defend, indemnify, release, and hold harmless Bionews, Inc., our affiliates, advertisers, licensors, licensees, distributors, agents, representatives, and other authorized users, and each of the foregoing entities’ respective resellers, distributors, service providers and suppliers, and all of the foregoing entities’ respective managers, members, officers, directors, owners, employees, agents, representatives, successors, and assigns harmless against any and all claims, actions, losses, damages, liabilities, injuries, causes of action, and costs (including, without limitation, settlement costs and any legal or other fees and expenses for investigating or defending any actions or threatened actions) whatsoever that are in any way caused by, arise out of, or result from, your creation and submission of the Content, or the use of the Content or any works derived from the Content, incurred by the indemnified, on any legal theory whatsoever, including without limitation, claims for copyright infringement, trademark infringement, patent infringement, trade secret misappropriation, invasion of privacy, violation of publicity rights, and defamation.
Reporting Claims of Copyright Infringement
We take claims of copyright infringement seriously. We will plan to respond to notices of alleged copyright infringement that comply with applicable law.
